Before You Begin: Please Read Carefully

You may file a complaint if you worked in Michigan and believe your employer:

  • Did not pay you wages or fringe benefits
  • Did not pay minimum wage or overtime
  • Violated the Earned Sick Time Act

Filing Deadlines

  • Earned Sick Time Act violations: must be filed within 3 years
  • Unpaid wages or fringe benefits: must be filed within 12 months
  • Minimum wage or overtime violations: must be filed within 3 years

Complaints filed after these deadlines cannot be accepted.

Do Not File a Complaint If:

  • You did not work in Michigan
  • You have already sued your employer or received a court judgment
  • You are only trying to get a W-2 or 1099 (contact the IRS instead)
  • Your employer has filed for bankruptcy
  • You do not know your employer’s address
  • The violation occurred outside the allowed time limits listed above

What You Will Need

Please have copies (not originals) of documents that support your claim. These may include:

  • Pay stubs or time records
  • Employment contracts or wage agreements
  • Commission statements or invoices
  • Written policies on vacation, sick leave, bonuses, or reimbursements

You may also send additional documents by email, mail, or fax after submitting your complaint.

After You File

  • Your complaint will be reviewed to determine if it falls under the Wage and Hour Division’s jurisdiction
  • If accepted, an investigator will be assigned and both parties will be notified
  • Investigations are handled in the order received and may take time depending on the complexity of the case

Keep Your Contact Information Updated

You must notify the Wage and Hour Division if:

  • You receive any payment from your employer related to the claim
  • Your address or phone number changes

Failure to update your contact information may delay or close your case.
